1. Scope and Application

1.1. These Terms and Conditions govern all agreements between Digital Munich’s Lumen (hereinafter “Digital Munich”, “Lumen”, “we” or “us”) and participants (hereinafter “you” or “participant”) enrolling in Digital Munich’s Lumen bootcamp programs. By registering for a Digital Munich’s Lumen bootcamp, you agree to be bound by these terms. Digital Munich is the company behind Lumen bootcamp and these terms govern your participation in the program and outline your rights and obligations.

1.2. These terms supersede any prior agreements, communications, or understandings related to Digital Munich’s Lumen offerings. Updated versions of these terms will be accessible on the Digital Munich’s Lumen website.

2. Eligibility Requirements

2.1. Participants must be at least 18 years old and possess the necessary prerequisites as specified for each program. Enrolment is subject to acceptance by Digital Munich, which reserves the right to refuse admission at its discretion.

2.2. For applicants under 18 years of age, parental or guardian consent is required for enrolment. In such cases, the parent or guardian must co-sign the enrolment agreement and assume responsibility for the participant’s adherence to these Terms and Conditions.

3. Description of Offer, Contract and Onboarding

3.1. Offer: The binding offer (the “Offer”) is made directly to participants upon their successful consultation with a Digital Munich’s Lumen representative or program advisor. This Offer includes detailed descriptions of the selected Program, its duration, and the services provided.

3.2. Acceptance of Offer: Participants accept the Offer by confirming their enrolment through a signed agreement or an equivalent formal acknowledgment. A binding agreement is established upon receipt of the signed acceptance by Digital Munich.

3.3. Right to Refuse Enrolment: Digital Munich reserves the right to decline issuing a contract or accepting a participant’s enrolment for reasons that include, but are not limited to:

  • Situations where the participant is assessed as unlikely to meet program requirements or succeed due to personal or professional constraints.
  • Past termination of a contract with Digital Munich due to misconduct or other violations of the Terms.
  • Inappropriate or unprofessional communication with Digital Munich team members, including abusive or disrespectful behaviour.
  • An evaluation that the program’s delivery model does not align with the participant’s stated learning goals or needs.

If a decision to refuse enrolment is made, the participant will be informed in writing, and the decision will be final.

3.4. Onboarding: After accepting the Offer and establishing a binding agreement, participants will undergo an onboarding process conducted by Digital Munich’s Lumen team. This onboarding includes:

  • Orientation sessions to familiarize participants with the platform and program structure.
  • Initial consultations with assigned mentors or instructors to set goals and expectations.
  • Guidance on accessing course materials and scheduling sessions.
  • Technical setup assistance to ensure a seamless learning experience.

3.5. Contracts for Participants in Germany: Participants residing in Germany must complete the contract form provided by Digital Munich, print, sign, and return it to Digital Munich GmbH by post. Acknowledgement of receipt will be sent to the participant’s email. In case of inconsistencies, the contract form takes precedence over these Terms.

4. Program Structure and Delivery

4.1. Course Content: Digital Munich’s Lumen offers intensive bootcamp programs in various tech-related fields. The specific curriculum, duration, and learning objectives for each program are outlined on our website and in the program descriptions provided to participants. The program includes online coursework, optional live sessions, hands-on projects, internships, and mentorship.

4.2. Mode of Delivery: Our bootcamps are primarily delivered online through our proprietary learning platform. In some cases, optional in-person sessions may be available.

4.3. Timelines: Digital Munich’s Lumen offers self-paced programs to enable participants to learn at their own pace. The participants can choose from full-time (6 months) and part-time (12 months) programs.

4.4. Mentor and Career Specialist Calls: Participants are entitled to a set number of calls with mentors, as specified by their Program. The following rules apply:

  • Calls must be scheduled at least 48 hours in advance.
  • If participants are unable to attend a scheduled call, they must cancel at least 24 hours prior to the call.
  • Failure to cancel within this timeframe will result in the call being considered completed and deducted from the participant’s allowance.

4.5. Technical Requirements: Participants are responsible for ensuring they have the necessary hardware, software, and internet connection to participate in the bootcamp. Digital Munich will provide a list of minimum technical requirements for each program. Digital Munich cannot be held liable for any technical difficulties arising from participant’s failure to meet these requirements.

5. Enrolment and Fees

5.1. Application Process: To enrol in a Lumen bootcamp, you must complete our application process, which may include an interview and/or assessment. Digital Munich reserves the right to accept or reject applications based on the eligibility criteria and program requirements.

5.2. Tuition Fees: Tuition fees for each program are clearly stated on our website and in the enrolment agreement.

5.3. Payment Methods: Multiple payment plans are available. Payments may be made upfront or in instalments as agreed upon during enrolment. In case of instalment-based plan, a down payment has to be made to confirm the enrolment, thereafter a monthly payment will be made latest by 5th of every month for the current month.

5.4. Late Payments: Late payment of instalment fees may result in suspension of program access. Persistent non-payment may lead to termination.

5.5. Program Extension: Access to mentoring is included for a fixed period, but participants can opt to extend their program for a monthly fee. This extension can be arranged by writing an email to info@digitalmunich.com. The right to terminate the contract remains unaffected by such extensions.

6. Contract Term and Withdrawal

6.1 Contract Term: The contract is entered into for the period booked by the participant.

6.2 Right of Withdrawal: Participants have the right to withdraw from the contract within 14 days from the enrolment date without providing a reason. To exercise this right, the participant must notify Digital Munich by submitting a cancellation request by sending email at info@digitalmunich.com. If the participant withdraws during the withdrawal period, Digital Munich will refund all payments received excluding transaction and delivery costs.

6.3 Effects of Withdrawal: After a withdrawal request is processed by Digital Munich, the participant will lose access to all learning materials, mentoring sessions, and other services associated with the program. Refunds will be issued using the same method of payment as the participant used initially.

6.5 Withdrawal Process:  Withdrawal from the program can be carried out by sending an email to info@digitalmunich.com. Termination becomes effective once the notification is received by Digital Munich.

6.7 Cancellations After the Refund Period: If the participant cancels the program after the 14-day refund period, they may be eligible for a prorated refund based on the time remaining in the program as follows:

  • Upfront payment plan or the participant has paid full course fee:
    • If less than 60% time has passed or less than 60% course has been completed, then the participant is eligible for a prorated refund on the basis of time left.
    • Afterwards, the participant cannot cancel, and no refund will be made.
  • Instalment-based plan or the participant has not paid full course fee:
    • If less than 60% time has passed or less than 60% course has been completed, then nothing will be charged for remaining months. The down payment will not be refunded, and the current month will not be refunded.
    • Afterwards, the participant cannot cancel and need to continue payments.

6.8 Re-enrolment and Discounts: If the participant cancels and later re-enrols, they will not be eligible for any discounts that applied to their original enrolment. Re-enrolment will require payment based on the price at the time of re-enrolment.

6.9 Change of program: Change of program will be regarded as cancellation of existing program and enrolment in a new one. Digital Munich reserves the right to offer a discount for the transition, but this will be dealt on a case-by-case basis.

6.10 Digital Munich’s Right to Cancel Enrolment:
Digital Munich reserves the right to discontinue a User’s enrolment under the following conditions:

  • Progress Delays: Falling significantly behind in progress, amounting to more than two months for a 6-month program
  • Non-payment: Failure to meet financial obligations, including missing instalment payments for more than one month.
  • Academic Integrity: Submitting plagiarized work. A first instance will result in a warning, with an opportunity to resubmit. Repeated offenses may result in termination.
  • Missed Commitments: Consistently failing to attend scheduled meetings or calls with Mentors or Advisors without prior notification.
  • Code of Conduct Violations: Breaching Digital Munich’s Code of Conduct in any form, including inappropriate behaviour in communication channels or toward Mentors, Advisors, staff, or peers.
  • Feedback Implementation: Repeated failure to apply constructive feedback provided by Mentors or Advisors.
  • Prior Enrolment Disclosure: Failure to disclose prior attendance or enrolment in Lumen Programs, including use of multiple accounts or identities.

In such cases, Digital Munich will notify the participant in writing. Termination due to these reasons may result in immediate loss of access to Program materials, platform features, and related services.

7. Participant Obligations

7.1. Attendance and Participation: Participants are expected to actively engage in the bootcamp, complete assignments, and adhere to the program schedule. Failure to meet participation requirements may result in dismissal from the program. In case of unforeseen circumstances and emergencies, the participants are advised to reach out to info@digitalmunich.com as soon as possible.

7.2. Code of Conduct: Participants are expected to maintain professionalism, respect, and integrity throughout the program. Any form of harassment, discrimination, or academic dishonesty may result in immediate dismissal without refund.

8. Digital Munich’s Obligations

8.1. Quality of Instruction: Digital Munich commits to providing high-quality instruction and support throughout the bootcamp. We will make reasonable efforts to ensure that the curriculum remains up-to-date and relevant to industry standards.

8.2. Support Services: Digital Munich will provide academic and technical support to participants throughout the program. Support is available Monday through Friday, 9 AM to 5 PM CET, and will be provided through our platform’s support channels. The extent and nature of these support services will be outlined in the program description.

8.3. Program Changes and Cancellations: Digital Munich reserves the right to make changes to the program curriculum, schedule, or instructors as necessary. In the event of significant changes or cancellations, participants will be notified as soon as possible and may be eligible for a refund or alternative arrangements.

9. Intellectual Property

9.1. Course Materials: All materials provided during the program are the intellectual property of Digital Munich or its licensors and are for personal use only. Unauthorized distribution or reproduction is prohibited.

9.2. Participant Contributions: Projects and assignments created by participants remain their property; however, Digital Munich reserves the right to use anonymized versions for promotional or educational purposes. You can request exclusion by sending an email to info@digitalmunich.com.

10. Career Services
10.1. Career Support Services: Digital Munich offers career support services to participants as part of the job search package. These services include resume reviews, mock interviews, brand development, networking strategy, and job search guidance.

10.2. Internship Opportunities: Digital Munich provides internship opportunities to eligible participants.

  • Eligibility: To be considered for internship referrals, participants must fulfil the following requirements:
    • Age and basic qualification: The participant must be at least 18 years of age, with at least a high school diploma or equivalent.
    • Completion Requirement: The participant must have successfully completed all modules of their bootcamp program, achieving a 100% completion rate as determined by Lumen’s mentors and instructors.
    • Financial Obligation: All tuition fees must be paid in full before a participant becomes eligible for internship.
    • Professional Conduct: The participant must have demonstrated professional conduct throughout the program, adhering to Digital Munich’s Code of Conduct and maintaining a positive learning environment.
    • Skills Assessment: Digital Munich reserves the right to conduct a final skills assessment before placing a participant into internship to ensure the participant meets the required competency levels.
    • Work Permit: The participant must have the necessary permission to work in the country where the internship is offered.
    • Remote / On-site positions: The participant must be open to both remote and on-site positions.
    • Accommodation: The participant must be living in, or willing to relocate independently and at his/her own expense.
    • Language Proficiency: Participant must possess B1 level or higher proficiency in English and the official language in the participant’s country of residency (if other than English).
  • Internship Terms: Any internship secured through Digital Munich’s Lumen referrals will be subject to the terms and conditions set by the hosting company. Digital Munich is not responsible for the internship terms, working conditions, or any disputes that may arise between the participant and the hosting company.

10.3. Interview Referrals: Digital Munich will provide interview referrals to eligible participants under the following conditions:

  • Completion Requirement: Participants must have successfully completed all modules of their bootcamp program, achieving a 100% completion rate as determined by Digital Munich’s mentors and instructors.
  • Financial Obligation: All tuition fees must be paid in full before a participant becomes eligible for interview referrals.
  • Professional Conduct: Participants must have demonstrated professional conduct throughout the program, adhering to Digital Munich’s Code of Conduct and maintaining a positive learning environment.
  • Skills Assessment: Digital Munich reserves the right to conduct a final skills assessment before providing interview referrals to ensure the participant meets the required competency levels.
  • Time Limitation: Interview referrals may be subject to a time limitation (e.g., within 6 months of program completion) to ensure the relevance of the participant’s skills.

11. Certification
Upon successful completion of the program, participants will receive a certificate acknowledging their achievement. Certification is contingent upon meeting all academic and participation requirements.

12. Limitation of Liability
Digital Munich is not liable for any indirect, incidental, or consequential damages arising from participation in the program. Digital Munich’s liability for any claims arising from or related to these Terms and Conditions or the bootcamp program shall be limited to the amount of tuition paid by the participant.

13. Privacy and Data Protection

13.1. GDPR Compliance: Digital Munich processes personal data in accordance with the General Data Protection Regulation (GDPR).

13.2. Data Usage: Personal data is collected for program administration and will not be shared with third parties without explicit consent. 

14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Munich, Germany. Any disputes arising from these terms or the bootcamp program shall be subject to the exclusive jurisdiction of the courts in Munich, Germany.

15. Amendments to Terms and Conditions
Digital Munich reserves the right to modify these Terms and Conditions at any time. Participants will be notified of any significant changes via email or through the platform. The most current version will always be available on our website. By enrolling in Digital Munich’s Lumen bootcamp, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
